THINK OUTSIDE THE BARREL
We are looking for creative, out-of-the-barrel thinkers and brandy drinkers, visionaries with a game-changing product and business idea that could shake up the brandy industry. Invigorate the brandy category and stand to win big.
The top 3 entrants stand the chance of launching their own start-up brandy business, mentored by brandy industry stalwarts, with the additional cash prize of R30 000 each.
1.1 This promotional competition is organised by The South African Brandy Foundation, and Winetech (collectively “Promoters”).
1.2 The promotional competition is open to permanent residents of South Africa over the age of 18 years except any employee, director, partner, agent or consultant or any person directly or indirectly, who controls or is controlled by the Promoters, immediate family members, advertising agencies, advisers, dealers, suppliers and/or associated companies, and/or a participant who has won a prize through a promotional competition run by the Promoter at least three months prior to the announcement of the winner of the Prize (“Disqualified Persons”).
1.3 By entering the promotional competition, all participants and winners agree to be bound by these rules which will be interpreted by the Promoters, whose decision regarding any dispute will be final and binding. The Promoters reserve the right to amend, modify, change, postpone, suspend or cancel this competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoters reasonably deem necessary.
2.1 The promotional competition commences on 30 August 2021 and ends on 20 October 2021, both days inclusive. Entries received after the closing date will not be taken into consideration.
2.2 Participants stand a chance to win a prize of R30 000.
2.3 To be eligible for the Prize, participants are required to enter an innovative product development for brandy, with the purpose of contemporizing the category. Participants will be judged on not only the liquid and packaging, but the entire business plan, which is to include product launch plans, positioning, marketing plans, and sales channels.
2.4 Entries must adhere to the requirements for brandy (either potstill, Cape Brandy, Vintage Brandy or Blended Brandy) as set out in the Liquor Products Act, 60 of 1989.
2.5 Winning entrants will be supported and mentored in to assist them to launch their product into the market.
2.6 Winners will be determined by a panel of judges. The decision is final and no correspondence will be entered. It is the prerogative of the judges to decide if the quality of entries is up to prospective launch standard. If not, no winners will be announced.
2.7 Winners will be required to provide their proof of identity to verify that they are above the age of 18.
2.8 The Prize is non-transferable.
2.9 If the potential winners do not claim the Prize on or before 30 October 2021, the potential winners will be deemed to have rejected the Prize and it shall revert back to the Promoters.
2.10 No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions.
2.11 Winners grant permission for the Promoters to use their names and photographs in any advertising and promotional material for this competition. Winners may ask that their names be removed or refuse to take part in any publicity.
2.12 Responsibility is not accepted for entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
2.13 All participants and the winners, as the case may be, indemnify the Promoters, their advertising agencies, advisers, nominated agents, suppliers, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this promotional competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters) and/or use of the Prize.
2.14 Under the Consumer Protection Act (CPA), we need to keep records of all the people used to promote the Promotional Competition. We (or one of our subcontractors or affiliates) will keep this agreement for three years to serve as the record as required by the CPA.

3.1 The Promoters’ decision is final and binding and no correspondence will be entered into if any dispute arises in relation to the interpretation of the competition rules, However, any party may use other dispute resolution channels provided for by the CPA or other law.
3.2 This clause is separate and divisible from the rest of this agreement and stays effective even if this agreement ends or is invalid.
4.1 The participant understands and agrees that in order to conduct the competition, we must collect and process personal information about them. By entering this competition, the participant consents to the processing of his/her personal information.
5.1 By taking part in this competition you agree that you will not hold us liable for any losses, harm, damages, injury, claims or actions related to this competition. We are not liable for any failure of any technical element relating to this promotional competition that may result in an entry not being submitted.
5.2 Force majeure. No party will be responsible for any breach of this agreement caused by circumstances beyond its control.
5.3 These rules, including the duration of the competition, can only be reasonably changed (or superseded) by us in a written revision to these rules posted on the competition website or any other potential official competition communication methods we use to reach a majority of potential participants.
5.4 Income or other taxes relating to the prizes, if any, are the sole responsibility of the prize winner.
5.5 South African laws govern this competition.
5.6 If the Promoters need to, because of legislative or regulatory reasons, we may terminate the competition immediately and without notice. If this happens you will not have any claim against us.
12. Requirements for pot still brandy [7 (1) (b); 27 (1) (a) and (d)]
Pot still brandy bottled after 31 December 2013 shall –
(a) be distilled from the fermented juice of the product of the vine which is, under excise supervision, discontinuously distilled in batches using a pot still and distilled to an alcohol content of not more than 75 per cent;

(b) be matured by storage for a period of at least three years, and up to eight years, in oak casks with a capacity of not more than 340 litres;
(c) if matured for a period of more than eight years, be matured for the period exceeding eight years in oak casks with a capacity of not more than 1 000 litres; and
(d) have an alcohol content of at least 38 per cent.

13. Requirements for brandy [7 (1) (b); 27 (1) (a) and (d)]
(1) Brandy shall consist of a mixture of not less than 30 per cent, calculated on the basis of absolute alcohol, pot still brandy referred to in regulation 12 and not more than 70 per cent, calculated on the basis of absolute alcohol –
(a) wine spirit distilled from the fermented juice of the product of the vine to an alcohol content of at least 60 per cent; or

(b) a spirit which –
(i) has been distilled from fermented sugar exclusively obtained from the pulp that remains after the juice has been pressed from grapes, with or without addition of water;
(ii) has been distilled to an alcohol content of at least 95 per cent; and

(c) a mixture of wine spirit referred to in paragraph (a), and spirit referred to in paragraph (b).
(2) Brandy shall have an alcohol content of at least 43 per cent.

14. Requirements for vintage brandy [7 (1) (b); 27 (1) (a)]
(1) Vintage brandy bottled after 31 December 2013 shall consist of a mixture of –
(a) not less than 30 per cent and not more than 80 per cent, calculated on the basis of absolute alcohol, of the product referred to in regulation 12(a), which has been matured for a period of at least eight years in oak casks with a capacity of not more than 340 litres; and
(b) not more than 70 per cent and not less than 20 per cent, calculated on the basis of absolute alcohol, wine spirit referred to in regulation 13(1)(a) or a spirit referred to in regulation 13(1)(b) or a mixture of such wine spirit and spirit, which has been matured for a period of at least eight years in oak casks with a capacity of not more than 340 litres.
(2) If the mixture or percentage thereof as referred to in subregulation (1) is matured for a period of more than eight years, it shall be matured for the period exceeding eight years in oak casks with a capacity of not more than 1 000 litres.
(3) Vintage brandy shall have an alcohol content of at least 38 per cent.
